Аннотация. В статье проводится сравнительно-правовой анализ регулирования телемедицины в государствах Евразийского экономического союза (ЕАЭС). Рассматриваются подходы, сложившиеся в Республике Беларусь, Республике Казахстан, Республике Армения и Кыргызской Республике. Цель исследования заключается в выявлении особенностей национальных моделей правового регулирования телемедицины и основных тенденций их развития в условиях цифровизации здравоохранения и интеграционных процессов в рамках ЕАЭС. Исследование основано на применении сравнительно-правового, формально-юридического методов и элементов системного анализа. Установлено, что государства ЕАЭС используют различные подходы к регулированию телемедицины, отличающиеся уровнем нормативной проработки и степенью институционального развития. Одновременно выявлены общие проблемы, связанные с защитой персональных данных пациентов, лицензированием телемедицинской деятельности, цифровой идентификацией участников дистанционного взаимодействия и использованием единых цифровых стандартов. Проведенный анализ показывает наличие тенденции к постепенному сближению подходов к регулированию телемедицины в государствах ЕАЭС.

National Models of Legal Regulation of Telemedicine
in the EAEU Member States Under Eurasian Integration

Abstract. The article provides the results of a comparative legal analysis of the regulation of telemedicine in the member states of the Eurasian Economic Union (EAEU). It examines the approaches established in the Republic of Belarus, the Republic of Kazakhstan, the Republic of Armenia, and the Kyrgyz Republic. The study aims to identify the specific features of national models of legal regulation of telemedicine and the main trends in their development in the context of healthcare digitalization and integration processes within the EAEU. The study is based on the application of comparative legal and formal legal methods, as well as elements of systems analysis. It is demonstrated that the EAEU member states employ various approaches to the regulation of telemedicine, which differ in their level of regulatory elaboration and degree of institutional development. The study also reveals common challenges, including those related to the protection of patients’ personal data, the licensing of telemedicine activities, the digital identification of remote participants, and the use of unified digital standards. The analysis demonstrates a trend toward the gradual convergence of approaches to telemedicine regulation across the EAEU member states.
