О содержании правового статуса главы республики
в составе Российской Федерации

Аннотация. В статье рассмотрены вопросы элементного состава конструкции «правовой статус главы республики». Показаны существующие в специальной литературе мнения относительно выделения элементов правового статуса субъекта права. Федеральный законодатель закрепляет общий правовой статус высшего должностного лица субъекта РФ, особенности отражаются в нормативных правовых актах республик. Эти особенности порождаются статусом республики как национального образования, именуемого в Конституции РФ государством. Диалектический метод познания позволил выявить взаимосвязи в элементном составе правового статуса главы субъекта РФ, обусловленные национальными традициями (наименование главы, компетенционные особенности). Применение специальных методов (формально-юридического, сравнительно-правового) дало возможность раскрыть элементный состав правового статуса главы республики. Правовой статус высшего должностного лица республики определяется временными рамками, начало которых фиксируется с принесением присяги вновь избранным на эту должность лицом, а завершение – вступлением в должность нового главы. Элементами правого статуса являются статическая, компетенционная и юрисдикционная (ответственность) составляющие. Специфика правового статуса главы республики проявляется в статической и компетенционной элементах, поскольку в них находят отражение национальные особенности республик.

On the Contents of the Legal Status of the Head of a Republic
in the Russian Federation

Abstract. The article addresses questions of the element of the structure “legal status of the head of the republic”. It shows existing opinions in the special literature regarding the identification of elements of legal status of a subject of law. Federal law establishes the general legal status of the highest official of a constituent entity of the Russian Federation, with specific details reflected in the republics’ regulatory legal acts. These specific details arise from the republic’s status as a national entity, referred to as a state in the Constitution of the Russian Federation. The dialectical method of cognition made it possible to identify the interrelationships in the elemental composition of the legal status of the head of the subject of the Russian Federation, due to national traditions (the name of the head, the competence features). The use of special methods (formal-legal, comparative-legal) made it possible to reveal elements of the legal status of the head of the republic. The legal status of the highest official of the republic is determined by time limits, beginning with the swearing in of the newly elected person to that office and ending with the inauguration of a new head. The elements of the legal status are static, competency and jurisdictional (responsibility) components. The peculiarities of the legal status of the head of the republic are manifested in the static and competency component, since they reflect the national characteristics of the republics.
