Эффективность тактических приемов производства очной ставки

с использованием систем видео-конференц-связи

Аннотация. В статье рассмотрены прикладные вопросы использования систем видео-конференц-связи в производстве очной ставки и влияния этих систем на организационное и тактическое обеспечение расследования. Выявлены три группы организационных ситуаций, складывающихся в процессе подготовки к очной ставке с использованием видео-конференц-связи. Проведен общий анализ эффективности условий и тактических приемов очной ставки с использованием видео-конференц-связи: выбор устойчивого ранее допрошенного участника, способного отстаивать свои показания через использование психологически наступательных приемов воздействия на оппонента; установление психологического контакта с лицом, отстаивающим правдивые показания по делу; параллельный анализ показаний проверяемых лиц; создание психологически напряженной атмосферы для участников; использование конфликтных отношений между участниками; детализация показаний участников; предъявление доказательств; допрос участников очной ставки по очереди; допрос участников в отношении противоречащих обстоятельств в хронологическом порядке их возникновения. Сделан вывод о преимуществе производства очной ставки в традиционном, очном порядке взаимодействия коммуницирующих участников.

The Effectiveness of Tactical Methods of Face-To-Face Confrontation

using Video Conferencing Systems

Abstract. The article examines the practical aspects of using videoconferencing systems in confrontations and their impact on the organizational and tactical support of an investigation. Three groups of organizational situations are identified that develop in the process of preparing for a face-to-face meeting using video conferencing. A general analysis of the effectiveness of the conditions and tactics of the confrontation using video conferencing is carried out: choosing a stable previously interrogated participant who is able to defend his testimony through the use of psychologically offensive methods of influencing an opponent; establishing psychological contact with a person defending truthful testimony in the case; parallel analysis of the testimony of the persons being examined; creating a psychologically tense atmosphere for participants; the use of conflict relations between participants; detailing the testimony of participants; presentation of evidence; interrogation of the participants in the confrontation in turn; interrogation of the participants regarding conflicting circumstances in chronological order of their occurrence. The conclusion is made about the advantage of conducting a confrontation in the traditional, face-to-face manner of interaction between communicating participants.
